HOW TO TRANSFER A WATER CERTIFICATE TO A NEW SHAREHOLDER

Only the Name, Names, or Entity in which the Share Certificate is issued by the Animas Consolidated Ditch Company, have legal right to Animas Consolidated Ditch Company Water. 

All transfers must be accompanied by the ORIGINAL Share Certificate from the party who is transferring the water. If the original Share Certificate is lost, a Lost Certificate filing process must take place prior to any transfer commencing. 
This process can take up to eleven weeks to complete. 

Transfers occur for many reasons; the following are just a few examples:

•Sale of Property. 
•Marriage. 
•Divorce, 
•Death of a Share Holder. 
•Establishment of a Trust. 
•Addition of a Party (Joint Tenancy). 
•Refinancing it the Mortgagee as Joint Tenant.

Certain documentation may be required from the person(s) transferring the water shares. Also, certain documentation may be required from the person(s) receiving the transfer. As each circumstance is very individualized, it is imperative that good communication exist between all parties and the Animas Consolidated Ditch Company. 

If you have not been issued a Share Certificate by the Animas Consolidated Ditch Company, you have NO legal right to any water.  

All outstanding maintenance fees, assessments and other charges, must be paid in full for a Share Certificate transfer to take place. 

The fee for transferring a Share Certificate is $300.00. The fee for the Lost Certificate Filing process is $300.00 to file for a Lost Certificate, $300.00 to issue a new Share Certificate, $350.00 - $425.00 for the Lost Certificate publication costs, and any legal fees associated with the process.
